Instax Digi respects the intellectual property rights of others and expects users of our platform to do the same. This DMCA Policy outlines our process for handling copyright infringement claims in accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

1. Notification of Claimed Infringement

If you believe that any content on instaxdigi.com infringes your copyright, you may submit a written DMCA notice to our designated Copyright Agent.

Your DMCA notice must include the following:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• Identification of the copyrighted work(s) you claim to have been infringed;
• Identification of the material that is claimed to be infringing, including URLs or other information reasonably sufficient to locate it;

• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

2. Counter-Notification Procedure

If you believe that your content was removed in error or misidentification, you may file a counter-notification.

Your counter-notice must include:

• Your physical or electronic signature;
• Identification of the material that was removed and the location it appeared before removal;
• A statement under penalty of perjury that you believe the content was removed by mistake or misidentification;
• Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in Delaware and will accept service of process from the original complainant.

If we receive a valid counter-notice, we may reinstate the content unless the original claimant files a court action within 10 business days.

3. Repeat Infringers

Instax Digi reserves the right to terminate accounts of users who are repeat infringers, at our sole discretion, in compliance with Section 512(i) of the DMCA.

4. Limitation of Liability

Instax Digi acts as an intermediary platform and does not review or monitor user-uploaded content before it is posted. We comply with DMCA takedown procedures in good faith and assume no liability for content uploaded by users, provided we act expeditiously on valid infringement claims.
